General license terms

The title(s) and sound recording(s) obtained through this website, and listed on your personal 'shopping cart', 'orders' or 'downloads' pages are protected throughout the world by Copyright. This License is granted to one user only (defined as one person or one Production Company at one business address). This License is valid when the purchaser agrees to, in writing or agreeing by email or by completing and submitting an online form, to the following conditions.

Rights

1)     The rights granted herein include the non-exclusive, worldwide rights to synchronize the sound recording(s) mentioned above in time relation with films, slide films, radio commercials, presentations and jingles, TV productions, promos and commercials (including satellite and cable programs, promos and commercials), theatrical productions, training and marketing presentations, internet and any other multimedia or audio-visual display or presentation.
2)     Martinworks allows only one (1) copy by itself, in whole or in part, without synchronization to visuals, for back-up purposes only. Any more copies require additional permission by the Publisher and writers.
3)     The term of this license is ninety-nine (99) years from the day the purchaser agrees to these terms.
4)     Martinworks and respective composer(s) warrants that it is the holder of the copyright and/or has contracted the rights to the music and has the right to grant the Licensee the permission in accordance with these terms.
5)     While the Licensee, by this license, acquires the physical property embodying the music (media) and the license to multiple uses, the Licensee does not acquire any ownership rights in the music or its underlying copyrights. The Licensee also agrees to keep the Licensor and composer(s) free and clear of any liability that may occur with each visual production that is synchronized with the composition(s).
6)     The Licensee agrees to exercise reasonable care with regard to the Moral Rights of the title(s). Use in pornography and racial propaganda is strictly prohibited.
7)     The Licensee agrees to fill out proper cue sheets with the relevant information when the visuals are to be broadcast on television andor satellite transmission and submitted to this website or directly to SOCAN. The recommended cue sheet forms can be downloaded from at www.socan.ca .
8)     Broadcasters and networks that are the end users of any productions containing our music must have a valid performance license from a performing Rights Society such as BMI, ASCAP or SOCAN.
9)     Licensee must obtain an extra license if the end product is to be in a manufactured product of more than 10,000 units (ie. Videos, DVDs, CD-ROMs including downloads). An extra license is also required if the music is to be used in Theatrical Motion Pictures, made-for-television movies, full length direct to video motion pictures, network programming and national television commercials. The extra license price for these special mediums is the equivalent to a second purchase of each song.

10) This agreement will be governed by the laws of the Province of Ontario (Canada)
11) This agreement shall be deemed effected electronically upon “acceptance”
